How we process your personal data under the Federal Act on Data Protection (FADP)

Dives Pater Learning Academy Sagl (hereinafter "Dives Pater", "we" or "the Company") is the data controller for personal data collected through the www.divespater.ch website and in the course of its training activities.

2. Legal basis and principles

We process personal data in compliance with the Federal Act on Data Protection (FADP, RS 235.1), the Ordinance on Data Protection (ODP, RS 235.11) and, where applicable, the European Union's General Data Protection Regulation (GDPR).

We process personal data lawfully, in good faith and in accordance with the principle of proportionality. We collect only the data necessary for the stated purposes and retain it only for as long as strictly necessary.

3. Personal data collected

Depending on how you interact with us, we may collect the following categories of personal data:

3.1 Data provided directly

  • Contact data: first name, last name, e-mail address, telephone number, postal address
  • Professional data: role, company or organisation, industry
  • Course registration data: training preferences, experience level, specific requirements
  • Billing data: company name, billing address, VAT number
  • Communications: content of messages sent via contact forms, e-mail or telephone

3.2 Automatically collected data

  • Technical data: IP address, browser type, operating system, screen resolution
  • Navigation data: pages visited, duration of visit, referrer, date and time of access
  • Technical and analytical cookies (see section 8)

4. Purposes of processing

Personal data is processed for the following purposes:

  • Provision of training services: management of enrolments, course organisation, issuance of certificates and certifications
  • Communication: responding to information requests, sending confirmations and operational communications
  • Administration and billing: accounting management, issuing invoices, fiscal obligations
  • Service improvement: aggregate and anonymous analysis of website usage to optimise content and functionality
  • Direct marketing: sending newsletters and course information, subject to the explicit consent of the data subject
  • Legal obligations: compliance with obligations under Swiss law

5. Disclosure of data to third parties

Personal data is not sold or transferred to third parties for marketing purposes. It may be disclosed to:

  • Technical service providers: hosting, e-mail, web analytics tools, acting as data processors on our instruction
  • Competent authorities: when required by Swiss law
  • Training partners: exclusively to the extent necessary for the delivery of joint courses, and with appropriate contractual safeguards

6. Transfer of data abroad

Some of our service providers may be based outside Switzerland. In such cases, the transfer takes place only to countries that guarantee an adequate level of protection pursuant to Art. 16 FADP, or on the basis of standard contractual clauses or other appropriate safeguards in accordance with Art. 16(2) FADP.

The list of countries with an adequate level of protection is established by the Swiss Federal Council (Annex 1 ODP).

7. Retention period

Personal data is retained for the time necessary to achieve the purposes for which it was collected and in any case in compliance with the retention periods provided for by Swiss law:

  • Accounting and tax data: 10 years (Art. 958f CO)
  • Contractual data: for the duration of the contractual relationship and for the subsequent 10 years
  • Contact data for marketing: until consent is withdrawn
  • Navigation data and logs: maximum 12 months

At the end of the retention period, data is deleted or irreversibly anonymised.

8. Cookies and tracking technologies

Our website uses technical cookies necessary for the operation of the site. We may also use analytical cookies to understand how the site is used and improve the user experience.

  • Technical cookies (essential): necessary for navigation and the functioning of the site. Do not require consent.
  • Analytical cookies: used to collect aggregate and anonymous information about the use of the site. They are activated only with the prior consent of the user.

9. Rights of the data subject

Pursuant to the FADP, every person has the right to:

  • Access (Art. 25 FADP): request whether and what personal data concerning them is being processed
  • Rectification (Art. 32(1) FADP): request the correction of inaccurate data
  • Erasure: request the deletion of their data, subject to legal retention obligations
  • Data portability (Art. 28 FADP): request delivery of their data in a commonly used electronic format or its transmission to another data controller
  • Objection: object to the processing of data for direct marketing purposes
  • Withdrawal of consent: withdraw at any time a previously given consent, without prejudice to the lawfulness of processing carried out prior to withdrawal

You can send your request to info@divespater.ch. We will respond within 30 days of receiving the request, once we have verified your identity.

10. Data security

Dives Pater adopts appropriate technical and organisational measures to protect personal data from unauthorised processing, accidental loss, destruction or damage, in accordance with Art. 8 FADP and Arts. 1-4 ODP. Such measures include encryption of communications, access control and periodic staff training.

In the event of a data security breach that entails a high risk to the personality or fundamental rights of the data subject, we will promptly notify the Federal Data Protection and Information Commissioner (FDPIC) in accordance with Art. 24 FADP.

11. Third-party websites

Our website may contain links to third-party sites. We are not responsible for the data protection practices of those sites. We encourage you to read their privacy policies before sharing any personal data.
